3. Introduction
3.1. The Axon Academy Online Ltd website provides students with Tutors, also known as Mentors, through online meetings platforms such as Google Meeting, Zoom, Microsoft Teams, etc. Axon Academy Online to market its services, and for Students to book and pay for Lessons. All of these terms and conditions apply to Students and Tutors (also known as Mentors).
3.2. The Axon Academy Online Website is owned and operated by Axon Academy Online Ltd, trading as Axon Academy Online. Axon Academy Online is a limited liability company registered in England and Wales under company number 15670124. Axon Academy Online ‘s other contact details are set out on the Website, which is at https://axonacademy.online
3.3. Throughout this document, the terms “us”, “our” and “Axon Academy Online” refer to Axon Academy Online LTD, and all directors, employees, contractors or other representatives of Axon Academy Online. The phrases “The website” or “our website” refer to the domain www.6med.co.uk and all pages within it.
3.4. The term “Our services” refers to any documentation, guidance or support offered, whether paid for or free of charge. Words in their singular include the plural and vice versa. Examples are included for illustrative purposes only and do not limit the interpretation of this contract.
3.5. A User may register on the Website as a Student or as a Tutor. A User may use the Website without registering, but if a User does register, certain information will be stored, making future visits to the Website easier.
3.6. By registering on or using our Website, the User agrees to be bound by these terms and conditions. These terms and conditions are legally binding – every User should read them fully before agreeing to them. (Please print or save these terms for future use as Axon Academy Online will not keep a file copy specifically for the User and Axon Academy Online cannot guarantee that they will remain accessible on the Website in future.) If a User does not wish to be bound by these terms, they should not use the Website.
4. Axon Academy Online Rights & Responsibilities
This clause sets out what Axon Academy Online promises to do:
4.1. To help Tutors and Students to meet by organising a lesson on behalf of both parties.
4.2. To maintain a functioning Website, including communication systems, shopping platform and members page, wherever possible. Axon Academy Online cannot guarantee that the Website will always be available, or that it will always work, but it will try to have it up and running properly at all times. Every now and again, the Website might need to be taken offline for maintenance purposes.
4.3. To communicate any planned maintenance of the Website or downtime.
4.4. To use reasonable endeavours to keep the Website free from viruses and worms.
4.5. To use reasonable endeavours to check the identity of all Tutors and the background checks of Tutors. (But if a Student is concerned about any Tutor, do not meet a Tutor alone and contact Axon Academy Online at the contact provided on the Website.)
4.6. To decide when a Tutor’s profile is sufficiently complete to be set live on the Website and be visible to other Users.
4.7. To communicate new Bookings, confirmation of Bookings and cancellations, to both Students and Tutors via phone, SMS, WhatsApp and email (except where a Student or Tutor has chosen to alter their notification settings to exclude email communication).
4.8. To endeavour to ensure that each Student’s payment of Lesson Fees and the payment of each Tutor’s Tutor Fees are processed promptly and usually within 14 days of a Lesson, when there is no Complaint, Dispute or Failed Payment. In case of Complaint, Dispute or Failed Payment the payment to tutor will be completed upon investigating and resolving an issue.
4.9. To endeavour to ensure Complaints are considered promptly and in accordance with these terms and conditions.
4.10. To endeavour to ensure that refunds to Students are made promptly in accordance with these terms and conditions.
4.11. To take precautions Axon Academy Online considers appropriate to protect Students' and Tutors' information.
4.12. To monitor postings made on the Website, emails, WhatsApp and SMS messages sent between Students and Tutors. Axon Academy Online does so in the hope of helping Students and Tutors meet, but also to stop misuse of the Website, as set out in these terms and conditions.
4.13. This website includes links to other websites which are neither owned nor operated by us; this does not represent an endorsement.
4.14. We make no claims of association with any third parties to whose websites our website links; neither do we make any guarantees regarding the accuracy or usefulness of these websites or their content. These links are provided only for your convenience and we neither hold responsibility for, nor give any warranties for, nor make any representations regarding the content, usefulness or functionality of any such websites and/or services. We are neither responsible for, nor liable in relation to, the content or your use of such websites.
5. Indemnity and/or Limitations of Liability
5.1. No representations, warranties or terms of any kind are made in respect of this website or its contents, (including, without limitation, any views or comment made, any blog content and the content of our members resources) other than those required by law.
5.2. All information provided on the website or in any associated documents is to be considered guidance only. Your use of such information and/or data is therefore entirely at your own risk.
5.3. We expressly exclude, to the fullest extent permitted by law, all liability of Axon Academy Online Ltd, its directors, employees, contractors or other representatives for any loss, howsoever arising, suffered or claimed to be suffered as a result of your use of this website, any of our information sources or our services. Additionally, we make no promises or guarantees regarding the accuracy or efficacy of any information, or any interpretation thereof, provided by the website, our resources, our services or in any other way by Axon Academy Online.
5.4. Any information provided by Axon Academy Online in any format is to be considered guidance, and every individual is responsible for choosing how they wish to use such information in light of that.
5.5. In brevity, Axon Academy Online is purely an advisory service; Axon Academy Online does not make any guarantees regarding the outcome of any admissions tests, exam or university applications and cannot be held liable for any unsuccessful outcomes.
5.6. All our content is the personal opinion of the author. They are unofficial, to be used only as a guide and Axon Academy Online takes no responsibility for their accuracy and will not be held liable for any losses associated with their usage.
6. User Responsibilities – this applies to both Students and Tutors, and anyone else who uses the Website and associated communication channels created by Axon Academy Online
6.1. Users are responsible for their own safety and security in conjunction with the services through the Website and associated communication channels such as phone, SMS, WhatsApp groups, emails, both online and offline.
6.2. Users are solely responsible for the material they post on the Website and associated communication, including messages sent.
6.3. Users must immediately report to Axon Academy Online any material that does not adhere to the terms and conditions set here.
6.4. Users must exercise their own judgement regarding the accuracy of information provided on the Website. Axon Academy Online cannot and does not guarantee that all of the content on the Website is complete, accurate or up-to-date.
6.5. sers must contact Axon Academy Online immediately if they believe their password has been compromised. Users will be responsible for the actions of any interactions conducted in their name until they have notified Tutorful that they believe their password has been compromised.
6.6. Users must not use the Website with the intention of engaging directly with other Users outside of the Axon Academy Online environment. Users must not promote opportunities or services of any company other than Axon Academy Online on the Website.
6.7. Users agree to abide by the Privacy Policy provided through the Website.
6.8. Any User who fails, in Axon Academy Online’s opinion, to comply with these terms and conditions may be immediately suspended from using the Website and any related services. Axon Academy Online reserves the right to cancel any existing bookings in such circumstances.
7. WhatsApp Communications
7.1. The following is an index of rules and regulations which have been proven to help create the best and safest environment possible for our Axon Academy Online WhatsApp chatters and members. These rules must always be adhered to by all chatters and members. By joining the WhatsApp group chat link you agree to follow all guidelines listed below:
7.2. The Axon Academy Online WhatsApp Group Chat is run by Axon Academy Online which reserves the right to censor, remove and ban any individuals that do not follow all rules and regulations that have been agreed upon and listed. The Axon Academy Online WhatsApp Group Chat are monitored and moderated, therefore, any individual that is seen partaking in any of the following content during conversation may be banned permanently from all Axon Academy Online services.
7.3. For example, we discourage:
– Racism/Anti-Semitism/Islamophobia/Hate
– Software Piracy
– Glorification of Alcohol/Drugs or Suicide
– Politics
– Sexual Conversation
– Religion
– Disrespectful discussion of another’s Culture or Nationality
7.4. The list above is not exhaustive, but demonstrative. Moderators and Admins will act on other topics that are deemed inappropriate and out of context with the philosophy of Axon Academy Online LTD.
7.5. Any threat, direct or indirect to this WhatsApp group chat, its owners or volunteers, will result in an immediate and permanent ban. We welcome all reasonable and mature suggestions or requests, but we will not tolerate threats or abusive remarks either on the Axon Academy Online WhatsApp group chat itself or through any written correspondence to the site. Threatening us will result in any and all correspondence being ignored as well as lessons or mentoring classes immediately cancelled without refund. Neither volunteer or administrator will tolerate abuse or hateful commentary of any kind.
8. Student Responsibilities
8.1. Axon Academy Online is not responsible for the acts or omissions of Students or Tutors and is solely responsible for its own acts or omissions.
8.2. Students must ensure that all of their personal details and contact information are accurate and up-to-date. Axon Academy Online will contact Students and their parents or legal guardian by phone, SMS, WhatsApp or email.
8.3. Student or their parent or legal guardian must provide suitable time and dates of the week when student can attend the lesson. While this will be taken into consideration, Axon Academy Online does not guarantee that such preferences will be met. Axon Academy Online will provide an alternative time and date of the week for lessons when student’s preferences can not be met.
8.4. To attend a Lesson with a Tutor, the Student must pay for the lesson on the Website at the rate provided on the website or via invoice sent by Axon Academy Online at a different or current rate. Axon Academy Online reserves the right to change the price at any time without notice.
8.5. Students are responsible for checking that time and day of the week of the lesson are correct and attend the lesson on time.
8.6. Students are responsible for ensuring that they have the correct equipment to be able to access the online lesson prior to an online lesson. No refunds will be made in the event that Students are unable to access the Online Classroom (via Google Meeting, Zoom, Microsoft Teams, etc) for whatever reason, save where such inability to access the Online Classroom arises as a result of Axon Academy Online failing to provide the services.
8.7. Any Student who fails, in Axon Academy Online’s reasonable opinion, to comply with these terms and conditions may be immediately barred from using the Website or associated communication channels and any related services. Axon Academy Online reserves the right to cancel any existing Bookings in such circumstances.
8.8. Cancellations: Students may cancel any Booking, without incurring any charge, by giving 48 hours notice.
8.9. Late arrival: Tutors are only obligated to attend the lesson at the set time and date. Tutors are not obligated to extend the time if the Student arrives late to the lesson regardless of the reason or prior notice.
8.10. Students agree to not use any means to record lessons purchased from Axon Academy Online. This includes storing or sharing them.
8.11. Students should not continue Lessons with the provided Tutor if Student is not happy with quality of the Lesson provided by the Tutor and seek refund. In case of unsatisfactory quality of the Lesson will seek feedback and provide reasonable solution. If no reasonable solution is found, Axon Academy Online will only refund the last lesson the Student had with the Tutor.
9. Cancellations
9.1. Student may only cancel via direct contact with the Tutor, using approved communication channels.
9.2. Cancellations made 48 or more hours before a Lesson is due to commence will incur no charge.
9.3. When a Booking is cancelled by a Student less than 48 hours before a Lesson is due to commence, Axon Academy Online will charge 100% of the lesson fees.
9.4. Bookings cannot be cancelled after the Lesson has started.
9.5. Lessons which are not attended by the Student will be charged at their full price unless cancelled more than 48 hours prior to lesson.
9.6. Tutors may cancel a Booking at any time prior to a Lesson taking place. To do so, Tutors must inform the Student directly via the approved communication channels. In the event of a Tutor cancelling a Booking where the reason given shows that they are not cancelling on behalf of the Student, the Student will not be charged any Lesson Fee. The lesson will be rescheduled to suit both the Tutor and the Student.
10. Missed Lessons and Complaints
10.1. “Complaint” covers any cause for the Student to seek a refund as a result of the service provided by the Tutor, including, but not limited to, a Missed Lesson (where the Tutor did not attend a Lesson booked through Axon Academy Online) or a claim about quality (where the Student feels that the service provided by a Tutor falls below the standards they reasonably expected).
10.2. A Student should inform Axon Academy Online of a Complaint via approved channels within 48 hours after the scheduled finish time of the relevant Lesson.
10.3. When a complaint has been received from a student, Axon Academy Online will contact the Tutor within 72 hours of the complaint being received, via approved communication channels message to inform the Tutor that a complaint has been raised.
11. Child Protection
11.1. Axon Academy Online seeks to provide the best service possible and provide a safe experience in which children can learn.
11.2. All Tutors must comply with the The Tutors' Association Child Protection Policy, whether or not they are a member of The Tutors' Association, and all relevant legislation and government guidance. 11.3. If any User has a concern regarding child protection, they should contact Axon Academy Online immediately.
